Meanings

The following terms are used within this document and when we use these terms, they have the following meaning.

“Enterware”, “We”, “Us”, “Our”, “Company” are references to Enterware Limited.
“Client”, “Customer”, “You”, “Your”, “Yours” are references to You, the person, individual or the individual acting on behalf of a company or third party using our website or service.
“Service”, “Services” are references to any service, product or plan that Enterware offer.
“Terms and Conditions”, “T’s and C’s, “TaC” are references to this document.
“Website”, “Portal” are references to www.enterware.co.uk on which these Terms and Conditions are displayed.
“Your Data”, “Your Details” are references to any information that you have entered via the website to register or use our services.

General Notes

By registering for an account, or using any service, plan or product provided by Enterware, the client agrees to abide and by bound by all points in these terms and conditions.

Enterware reserve the right to change any part of these terms and conditions at any time. Reasonable attempts will be made to inform you of any changes to this document and the latest version of this document will always be displayed on our website.

Failure to comply with and point or part of these terms and conditions will result in the appropriate action, as seen fit by Enterware and at the sole discretion of Enterware.

Enterware, Enterware staff, employees, associates, representatives and/or affiliates cannot be held responsible in any way for any damage incurred by any person or group in result of an action taken by Enterware (this covers, staff, employees, members, associates, representatives and affiliates) and / or an Enterware Client or Illegal User (hacker, illegally obtained account). Any damages, losses, fees, liabilities, expenses incurred by any person or group due to the use (or misuse) of any part of any service offered by Enterware or one of its affiliates will in no way be the responsibility / concern of Enterware.

By signing up for, holding an account with or using and service provided by Enterware, the client agrees to indemnify Enterware and all its affiliates, representatives, staff, members and associates from any costs (be they legal, emotional, monetary or other) that arise from the participation of a Client in any Enterware service.

Enterware reserves the right to refuse any service offered to any client and / or website at their sole discretion.

Enterware reserves the right to suspend and / or terminate and Client account, product or service at will and at their sole discretion.

The client agrees to use their account, service and / or product lawfully. The use of any product or service to host or promote any illegal material or activity will result on the service and / or product to be terminated without notice or warning.

This agreement applies for the length of time that a Client has an account or uses services or products provided by Enterware. The minimum length of contract is 6 months.

All prices exclude VAT at the current rate unless otherwise stated.

Domain Name Registration

Enterware are members of Nominet, and as such, any client agreeing to these terms and conditions also agree to the terms and conditions set out by Nominet. Copies or the Nominet Terms and Conditions can be found on the Nominet website. Enterware does not accept responsibility nor does it make any warranty that the domain name(s) requested by the Client will be accepted for registration by the Naming Organisation nor will Enterware be liable for any costs of the Client incurred if the application for registration is unsuccessful.

Enterware does not accept responsibility for any liability to Clients, or any third party, for breach of their Intellectual Property Rights in relation to any domain names requested by the Client.

Enterware will maintain the registration of any domain name(s) that you register via our website for the initial pre-paid registration / billing period. Enterware will notify you in advance of the end of your registration period and will offer to renew your domain name(s) at our current price. Only when full, cleared payment is received will Enterware attempt to renew the domain name. Should for any reason the domain name(s) renewal fail, then only fees for that failed renewal will be refunded.

Should your domain name(s) expire and you wish to renew your domain names with Enterware, you agree to pay, in addition to the current renewal fee, any charges levied and a late payment administration fee of £30 + VAT.

Any domain name registered by Enterware on behalf of a client will remain the property of Enterware until payment in full has been received and has cleared.

Domain Name Transfers

The following conditions apply for domain names transferred to Enterware and are in addition to those stated in the above section "Domain Name Registrations."

Clients may transfer any valid domain name that the client legally owns to Enterware from any other registrar where the customer agrees to pay any fees levied by the other registrar. Enterware will not charge for this service.

Clients may transfer any valid domain name that the client legally owns from Enterware to any other Registrar where the customer agrees to pay any fees levied by the other Registrar, and any outstanding fees imposed by Enterware are paid in full before the transfer takes place. Enterware can charge an additional transfer fee of £15 + VAT for any transfer.

Enterware does not accept responsibility for any liability to Clients, or any third party, for breach of their Intellectual Property Rights in relation to any domain names requested by the Client.

Any domain name registered by Enterware on behalf of a client will remain the property of Enterware until payment in full has been received and has cleared.
